SOUTH DAKOTA ONE CALL NOTIFICATION BOARD MEETING
Jan. 20, 2010

Acting Chairman, Jerry Schroeder, called the South Dakota One Call Notification Board meeting to order at 12:30 PM Central Time, in the Visitor Center at the State Capitol in Pierre, SD.

Board members in attendance: Jerry Schroeder, Golden West Telecommunications; Erin Hayes, Midcontinent Communications; Dan Kaiser, Qwest Communications; Eugene Solseth, Hills Septic Service; and Terry Larson, Heavy Construction;
Legal Counsel, Kara Semmler;
Larry Englerth, Executive Director Support (via teleconference);
Larry Janes, Executive Director.

Board members absent: Bleau LaFave, Northwestern Energy, Chairman; Kurt Pfeifle, Mid-Dakota Rural Water System, Vice-Chairman; Todd Chambers, Watertown Municipal Utilities; Kevin Kouba, Otter Tail Power Company; Ed Anderson, SDREA; and Doug Larson, Northern Border Pipeline.

Also in attendance: Dusty Johnson, Public Utilities Commissioner, Chairman; Steve Kolbeck, Public Utilities Commissioner, Vice-Chairman; Nathan Solem, Public Utilities Commission, Pipeline Safety Program Manager; Cindy Kemnitz, Public Utilities Commission, Finance Manager; Patty Van Gerpen, Public Utilities Commission, Executive Director; Margo Northrup; and Dennis Davis, South Dakota Rural Water Association.

Due to a lack of a quorum no votes or approvals took place.  These will be considered at the next regularly scheduled South Dakota One Call Notification Board Meeting.

A review of the Financial Summary and Call Volume trends were reviewed.  Approvals will be considered at the next regularly scheduled South Dakota One Call Notification Board Meeting.

OCS Performance Results were reviewed.

The following Executive Director Report items were discussed:

  1. A Centralized Mapping meeting was held December 15, 2009 at the Department of Public Safety in
    Pierre, with members from various state agencies to discuss the potential of creating a centralized
    depository of mapping data.
  2. Contract modifications with First District were made in December to reduce One Call expenses.
  3. The Executive Director discussed the presentation at the Ditch Witch University training seminar in
    Sioux Falls on January 5th and 6th and participation at the SD Rural Water Association in Pierre on
    January 13, 2010.
  4. OC09-002 – status of action pending against Mark Seifkes dba S.P.O.T. – SD One Call is on hold
    pending notification from the City Attorney of De Smet to resolve this issue.
  5. OC09-007 – SDN vs. Larry’s Electric – SDN has requested a Motion to Reconsider Committee
    Resolution.  Meeting will be held on January 21, 2010 at the SDREA Conference Room, located at 222
    West Pleasant, Pierre, SD.
  6. OC09-008 – SDN vs. Sharpe Enterprises —  SDN has requested a Motion to Reconsider Committee
    Resolution.  Meeting will be held on January 21, 2010 at the SDREA Conference Room, located at 222
    West Pleasant, Pierre, SD.
  7. Discussion was held on proposed Bar Hole Legislation and Court Order to Comply with Commission
    Order – Violation as contempt.
  8. One Call Board agenda approval and email voting and Enforcement Committee procedures were
    discussed.
  9. A discussion was held regarding Non-profit.
  10. Dennis Davis, SDRWA, discussed issues around other utilities placing facilities above water facilities
    and proposed legislation to discourage that activity.
  11. Dusty Johnson, Public Utilities Commissioner, Chairman made a presentation regarding pipeline
    safety.
  12. Nathan Solem gave a SD One Call and SD Pipeline Safety Relationship presentation.
  13. The Dinner with the Public Utilities Commission and Staff for the evening of January 20th was
    discussed.
  14. The Legislative Breakfast hosted by the South Dakota One Call Board for the Senate and the House
    of Representatives to be held on January 21, 2010 at 7:00 to 10:00 am (CST), 3rd floor of the State
    Capitol Building, 500 E Capitol Ave, Pierre, SD was mentioned.
