SOUTH DAKOTA ONE CALL NOTIFICATION BOARD MEETING
August 27, 2014  8 a.m.  CDT

1.   Chairman Erin Hayes opened the meeting with a Call to Order and Roll Call at 8a.m., Central Time.

Members in attendance: Chairman, Erin Hayes, Representing Community Antenna Television Systems, Chairman; Vice Chairman, Dan Kaiser, Representing Telecommunication Companies Offering Local Exchange Service to More Than 50,000 Customers; Ed Anderson, Representing Rural Electric Cooperatives; Fay Jandreau, Representing Telecommunication Companies Offering Local Exchange Service to Less Than 50, 000 Customers; John Ward, Representing Excavation Contractors; Kurt Pfeifle, Representing Rural Water Systems; Todd Chambers, Representing Municipalities. Also in attendance: Kristen Edwards, Legal Counsel; and Larry Janes, Executive Director.

Board members unable to attend: Bleau LaFave, Representing Investor-Owned Natural Gas Utilities; Doug Larson, Representing Interstate Carriers of Gas or Petroleum; Eugene Solseth, Representing Excavation Contractors; and Kevin Kouba, Representing Investor-Owned Electric Utilities.

2.   A motion was made by Dan Kaiser to approve the South Dakota One Call Notification Board Minutes of  the June 12, 2014 One Call Board Meeting.  Fay Jandreau seconded the motion. Motion carried unanimously upon a roll call vote.

5.   Erin Hayes stated that the Board would move at this time to Item 5 of the Agenda; discussion regarding a possible exemption in the law to allow digging in emergency situations before locates are complete. Michelle Payne had previously provided language to this effect for Board consideration. A question was raised as to who would introduce this to the legislature. Dave Caris stated that MidAmerican Energy would introduce this legislation. The consensus of the seven Board members in attendance was agreement to MidAmerican’s proposal. A letter will be sent to Michelle Payne stating that there is Board consensus.

3.   The Financial Summary, including May 2014 through July 2014 expenditure details, was reviewed.

Kurt Pfeifle made a motion to approve the report. Ed Anderson seconded the motion. Motion carried unanimously.  

4.   Center Performance Results were reviewed.  Speed of Service was discussed and is currently within contract guidelines. Call Volume Trends from January 2014 through July 2014 were reviewed. Incoming locate requests through July, are at 78,285. This is an increase of 4,858 over last year. Dispatched Tickets are at 477,515, which is a 36,480 increase from 2014. Electronic Ticket requests continue to climb since the introduction of Portal in February. 45 % of the total locate requests in June and July were generated electronically by excavators. 15% of all locate tickets generated electronically in August were also mapped by excavators, which required no intervention by the Center. Mapping by excavators allows them to receive their locate tickets immediately. Dispatched tickets by type were reviewed. There have been 2,726 Emergency Locate requests in 2014. Dan Kaiser brought up a question about if these were all valid Emergency requests. One known non-emergency request was mentioned. The discussion moved to it being necessary for operators to use the Complaint process when this type of violation is found.

6.   Chris Stovall, Texas811, provided a demonstration of the mobile app for Apple products. This app is available today and has been tested by Larry Janes over the last week and a half. The app for Android will be available in the next few weeks. Once it also becomes available, information will be sent out on Facebook, Twitter, and through notifications to ticket receivers announcing the South Dakota 811 app.

7.   Executive Director Report Items

  1. OC14-005     In the Matter of the Complaint Filed by Montana-Dakota Utilities Co., Rapid City, South Dakota, Against Al Sutton Electric, Rapid City, South Dakota, for an Incident Occurring on February 25, 2014, at 2017 E. Hwy 44, Rapid City, S.D.Today shall the One Call Board accept the recommendation of the Enforcement Panel, and shall the One Call Board close the Docket, and shall the Board pursue collection activity if the requirements are not met?

    After reviewing the Enforcement Panel process Dan Kaiser made a motion to accept the recommendation of the Enforcement Panel. Todd Chambers seconded the motion. Motion carried unanimously.

  2. OC14-006     In the Matter of the Complaint Filed by Montana-Dakota Utilities Co., Rapid City, South Dakota, Against Brewer Construction Inc., Piedmont, South Dakota, for an Incident Occurring on March 26, 2014, at 6782 Cambridge Ct., Summerset, S.D. Today shall the One Call Board accept the recommendation of the Enforcement Panel, and shall the One Call Board close the Docket, and shall the Board pursue collection activity if the requirements are not met?

    After reviewing the Enforcement Panel process Fay Jandreau made a motion to accept the recommendation of the Enforcement Panel. Kurt Pfeifle seconded the motion. Motion carried unanimously.

  3. OC14-007     In the Matter of the Complaint Filed by Montana-Dakota Utilities Co., Rapid City, South Dakota, Against Lind Exco, Rapid City, South Dakota, for an Incident Occurring on March 27, 2014, at 1851 Discovery Circle, Rapid City, S.D. Today shall the One Call Board accept the recommendation of the Enforcement Panel, and shall the One Call Board close the Docket, and shall the Board pursue collection activity if the requirements are not met?

    After reviewing the Enforcement Panel process Fay Jandreau made a motion to accept the recommendation of the Enforcement Panel. Erin Hayes seconded the motion. Motion carried unanimously.

  4. OC14-008     In the Matter of the Complaint Filed by Montana-Dakota Utilities Co., Rapid City, South Dakota, Against Warax Excavating Inc., Rapid City, South Dakota, for an Incident Occurring on April 11, 2014, at 616 Watts Ln., Rapid City, S.D. Today shall the One Call Board accept the recommendation of the Enforcement Panel, and shall the One Call Board close the Docket, and shall the Board pursue collection activity if the requirements are not met?

    After reviewing the Enforcement Panel process Kurt Pfeifle made a motion to accept the recommendation of the Enforcement Panel. Fay Jandreau seconded the motion. Motion carried unanimously.

  5. OC14-009     In the Matter of the Complaint Filed by South Dakota Network dba SDN Communications, Sioux Falls, South Dakota, Against First Rate Excavate, Sioux Falls, South Dakota, for an Incident Occurring on September 12, 2013, at 2800 W. 41st St., Sioux Falls, S.D. Today shall the One Call Board accept the recommendation of the Enforcement Panel, and shall the One Call Board close the Docket, and shall the Board pursue collection activity if the requirements are not met?

    After reviewing the Enforcement Panel process Kurt Pfeifle made a motion to accept the recommendation of the Enforcement Panel to dismiss the complaint for failure to file within the required 90-day period. Dan Kaiser seconded the motion.  Motion carried up on a roll call vote. Fay Jandreau abstained.

  6. OC14-010     In the Matter of the Complaint Filed by MidAmerican Energy Company, Urbandale, Iowa, Against Hodkinson Construction, Sioux Falls, South Dakota, for an Incident Occurring on April 25, 2014, at 511 and 515 S. Second Ave., Sioux Falls, S.D.Today shall the One Call Board accept the recommendation of the Enforcement Panel, and shall the One Call Board close the Docket, and shall the Board pursue collection activity if the requirements are not met?

    After reviewing the Enforcement Panel process Fay Jandreau made a motion to accept the recommendation of the Enforcement Panel. Dan Kaiser seconded the motion. Motion carried unanimously.

  7. OC14-011     In the Matter of the Complaint Filed by Mitchell Telecom, Mitchell, S.D., Against Schoenfelder Construction, Mitchell, S.D., for an Incident Occurring on June 10, 2014, at North Montana and West 8th Ave., Mitchell, S.D. Today shall the One Call Board accept the recommendation of the Enforcement Panel, and shall the One Call Board close the Docket, and shall the Board pursue collection activity if the requirements are not met?

    After reviewing the Enforcement Panel process Dan Kaiser made a motion to accept the recommendation of the
    Enforcement Panel. Fay Jandreau seconded the motion. Motion carried unanimously.

  11. OC14-015     In the Matter of the Complaint Filed by Montana-Dakota Utilities Co., Rapid City, South Dakota, Against RL Construction and Design, Hill City, South Dakota, for an Incident Occurring on April 16, 2014, at 2451 Emerson Ln., Rapid City, S.D.Today shall the One Call Board accept the recommendation of the Enforcement Panel to dismiss the complaint,  and shall the One Call Board close the Docket?

    After reviewing the Enforcement Panel process Fay Jandreau made a motion to accept the recommendation of the Enforcement Panel. Dan Kaiser seconded the motion. Motion carried unanimously.

  12. OC14-016     In the Matter of the Complaint Filed by Montana-Dakota Utilities Co., Rapid City, South Dakota, Against Hardeneye Concrete, Inc., Rapid City, South Dakota, for an Incident Occurring on April 23, 2014, at 22956 Candlelight Dr., Rapid City, S.D. Today shall the One Call Board accept the recommendation of the Enforcement Panel, and shall the One Call Board close the Docket, and shall the Board pursue collection activity if the requirements are not met?

    After reviewing the Enforcement Panel process Fay Jandreau made a motion to accept the recommendation of the Enforcement Panel. Kurt Pfeifle seconded the motion. Motion carried unanimously.

  13. Today, shall the One Call Board approve hosting a Legislative Breakfast on Wednesday, February 25, 2015, from 7a.m. to 10:00 a.m.?Kurt Pfeifle made a motion to host the Legislative Breakfast. Dan Kaiser seconded the motion. Motion carried unanimously.

8.   General Discussion:

  1. AgPhd Day – Baltic, S.D. – July 24, 2014. The executive director stated there were 9,000 attendees at this year’s event from 38 states and 7 foreign countries. Drain tile and irrigation were the main topics of discussion with South Dakota One Call. Ed Anderson will look into the possibility of participation by South Dakota One Call at Dakota Fest in 2015.
  2. August 11th (811 Day) was discussed. News articles were provided across the state. Erin Hayes mentioned that MidContinent Communications handed out 811 cookies to excavators in Sioux Falls and thanked them for using the 811 system.
  3. Amber Alerts and Endangered Missing Advisories were discussed. Larry Janes has been working with SD Bureau of Information and Technologies to look into issuing these alerts to ticket receivers. Four Amber Alerts have been issued since the inception of this program through the state. Endangered Missing Advisories have occurred about 12 or 13 times.  Quarterly alerts do go out. A question came up regarding whether or not a member or excavator could opt out. Chris Stovall
    thought this could be worked out. Work will continue with the Texas811 Center to implement the alert system through the Center.
  4. Facebook and Twitter accounts were discussed. Appropriate information from all Board members and their constituents is welcomed for posting.  Just submit any items to the Executive Director.
  5. There have been several South Dakota 811 website changes. The information on the homepage has been reduced for clarity, and two new tabs have been added; one for Homeowners and one for Landowners. These changes have been made to help address questions by these user groups.
  6. Ticket Search functionality for excavators and facility operators was discussed briefly. No changes will be made at this time.
  7. Kurt Pfeifle had asked the executive director in June, if South Dakota One Call could reach out to new excavators in South Dakota. Chris Stovall was contacted and requested such a list from his staff to be made available to the executive director on a weekly basis. In July there were 470 new excavators requesting locate tickets in South Dakota. The executive director is emailing “Welcome to South Dakota 811” letters each week to the newest additions.
  8. The CGA Conference is scheduled for  March 10- 12 , 2015.  More information will be provided to Board members about registration.
  9. The executive director asked if the location of the next Board Meeting should be moved. Cedar Shores in Chamberlain was mentioned as a possibility. It was felt by most that meetings in Pierre work out best for travelling by everyone. The next meeting will be scheduled the first or second week of November, if schedules allow.
  10. The executive director mentioned that he would like to add a list of private facility locators to the South Dakota 811 website. The list we currently have is limited and is only available when requested. A request of this nature will be sent to ticket receivers.
  11. Other.
    1. Ed Anderson mentioned that he’s received comments suggesting the Enforcement Panel raise the penalty amounts during the complaint process. He also mentioned that he would like to see the Board do more in its outreach efforts.  Todd Chambers mentioned this is being discussed within the Strategic Planning Committee.
    2. A visit to the Center is currently scheduled in October. There was some discussion about changing the date.

Being no further business, the executive director asked for a motion to adjourn. Fay Jandreau so moved. Kurt Pfeifle seconded the motion. Motion carried unanimously.
